AN IMPORTANT NOTE: On June 22, 2021, Hadari Oshri –Marc Lubaszka’s business partner– filed a civil harassment restraining order (CHRO) against Investor News reporter Aitana Vargas to stop the publication of her investigative series “A Special Report: The Harrowing Impunity of White-Collar crime,” and any subsequent installments or future media coverage. On August 3, 2021, Vargas filed an anti-SLAPP motion to strike Oshri’s CHRO petition. In a hearing held on September 13, 2021, Los Angeles Superior Court Judge Doreen Boxer granted Vargas’s anti-SLAPP motion and denied Oshri’s civil harassment petition for failure to sustain the applicable burden of proof. Oshri will now have to pay Vargas’s attorney’s fees for filing a frivolous case. The Israeli entrepreneur also declined to go on a recorded interview or provide statements via email.

Los Angeles (CA) – Probably 2021 was not a year for the books for Hadari Oshri. And things aren’t looking up in 2022 either.

Last year, the American-Israeli entrepreneur lost her meritless restraining order case against me. My anti-SLAPP court win was a powerful reminder of why First Amendment Rights are celebrated, honored and protected by Americans. And as an American citizen, Oshri should have known better. But she didn’t.

That I prevailed on my anti-SLAPP motion forced Oshri to learn the hard way. She will have to pay my hefty legal fees ($23,000). Additionally, in the past months, I’ve released the investigative series that she desperately tried to silence. And her sloppy PR efforts to deliver an online campaign aimed at clearing her name…miserably failed.

But today, I don’t want to focus so much on Oshri. Rather, I want to do some introspection.

To get this far, I had to spend the summer of 2021 fully immersed in time-consuming legal efforts to fight her frivolous restraining order. Because let’s be clear about one thing: Oshri, like every other SLAPPer, never intended to win in court. She intended to bully me into silence in the same way she used fear tactics in the past to silence her victims’ plights and grievances.

In early 2021, Oshri retained the legal services of LA-based attorney John Tamborelli in order to stop my investigative efforts. Around February 14th that year (a very symbolic date for Oshri and her high-caliber restraining order team of criminal defense attorneys), Tamborelli sent me a “cease and desist” letter, or as Oshri called it in her legal petition against me a “seance” and “disease.”

Realizing that the “seance” and “disease” strategy had failed, Tamborelli tried yet another trick: He had one of my sources “instruct” me to remove any and all media coverage that I’d posted online mentioning him, Oshri and Marc Lubaszka.

Of course, I refused to comply. But more importantly, the National Writers Union (NWU) sent Tamborelli a letter demanding that he stop all intimidation attempts towards me. And…he stopped.

If anything, I have come out of this experience understanding the many ways in which I must express my gratitude towards Hadari Oshri. She turned me into quite an expert on anti-SLAPP motions and meritless First Amendment Right cases. For three months last year, I was the anti-SLAPP motion version of the cookie monster. Like a maniac, I devoured legal cases, rulings and opinions by the CA lower courts, the Court of Appeals and the CA Supreme Court. Every case I found –even in other states or the US Supreme Court–, I read and carefully studied.

I am, however, humble enough to admit that I had –and I still do– a lot to learn in this regard. But for all the lessons already learned, I’d like to thank you, Hadari. You’ve made me a more informed, a better and a more accomplished journalist.

I never would have made it this far without your invaluable contributions. As a matter of fact, two weekends ago, I was presented with an LA Press Club award for my investigative series exposing your participation in an alleged multi-million dollar PPE scheme with Marc Lubaszka.

Speaking of milestones…This is my first journalism award for an English-language series produced entirely on my own!

I never thought I would be talented enough or even remotely capable of this kind of achievement. But you proved me wrong: Not only can I write in English, but I can also win awards in a foreign language!

Thank you, Hadari, for making this award possible. It’s unique, one of a kind, and the refreshing icing on the cake that I and many victims will never forget.

Drivers of Uber and Lyft are used as pawns by ridesharing company in an attempt to operate in California. Uber and Lyft should have been more proactive all along.

Both Uber and Lyft have decided to make this a messy divorce and seem like parents who have are using their kids as pawns in the courts. The problem is that the kids have grown up and are fed up with the arguing.

The ridesharing platforms have for years not even acknowledged their riders and employees, and have been negligent in many circumstances in taking care of safe working conditions at all levels.

While riders were heading out to clubs, restaurants and over to their latest tinder date for a Netflix and chill, Uber and Lyft decided that they were too big to fail.

This is a brand new world, COVID and Shutdowns has hurt the rideshare company but, more than that it has hurt the drivers, who are facing extreme hardship as a result of the drop in riders and trips.

It seems now Uber and Lyft want to act like they are the victims, being bossed around, but none of this is new to the world of contract employees in California. Now they are at an impasse and will effectively shut down in California on August 20th.

As usual, it is the Uber and Lyft drivers who will suffer. With many drivers using the driver app as a means to help pay rent, food, and basics, the Uber shut down will affect drivers the worst.

The Uber world of arrogance

Uber, has in the past been arrogant, they have been shut down in several countries and cities, for illegally operating their services.

Uber, has implemented work practices that have been frowned on by lawmakers and congress, but, as their meteoric rise to $72 billion valuations happened in 2016, the higher levels felt that they were untouchable.

Several key members of Uber’s C-level exes left the company prior to their 2018 IPO after many allegations were made public.

Uber and Lyft too little too late

Even after a decade, neither company has managed to turn a profit. The startups sold themselves to cities as creators of good jobs and providers of new transportation options. But the cities were hoodwinked by the fantasy, too — those jobs are precarious and low-quality; many workers hover around or below minimum wage and must clock dangerously long hours to hit ride targets and surge rates. Taxi drivers, meanwhile, were pushed out of business by the venture capital-fueled companies and are despairing. And city streets are more gridlocked than ever

After the ruling, both Uber and Lyft threatened to exit the state entirely if their legal appeals were defeated. Amazingly, this was less than 48 hours after Uber’s CEO Dara Khosrowshahi proclaimed in a New York Times op-ed that “gig workers deserve better.” If that means allowing the drivers who make his service possible to have basic employee benefits, though, he’d apparently rather shut the whole thing down.

Lyft meanwhile, was more straightforward in its appeal — it said that if it had to classify its workers as employees, it simply couldn’t afford to operate.

Uber — Shares of Uber climbed 0.4% after the ride-hailing company said it does not plan to shut its California Uber Eats operations due to the court case that forced it to suspend service in the state to reshape its business model. A judge recently granted a preliminary injunction requiring the company to reclassify drivers as employees, instead of contractors.

Uber and Lyft drivers have long complained about poor pay, lack of protections, and an inability to unionize to collectively bargain with the companies. There have been stories about drivers sleeping in their cars because they can’t afford to live in the cities where they work, struggling to make ends meet, and feeling totally at the mercy of a faceless algorithm that dictates when and where they drive and for how long.

Prop 22 Uber and Lyft

California is an obvious place for the line to be drawn in the sand. It’s where Uber and Lyft were founded and where they raised billions of dollars from investors before eventually going public. But neither company has ever been profitable. They both have actually set records for the amount of money lost in the run-up to their respective IPOs. And since going public, they have continued to bleed cash.

“Prop 22 is not just securing an AB 5 carveout for gig companies,” said Carlos Ramos, a 39-year-old Lyft driver based in San Diego and member of the pro-AB5 group Gig Workers Rising. “It is also designed by gig companies to ensure that these corporations are exempted from having to observe basic labor protections for workers for generations to come.”

Uber and Lyft have money to burn on advertising, a direct line of communication to their customers, and a willingness to lose tens of millions of dollars more to make their point. Going dark in one of its biggest markets in the country to really drive the message home about what’s a stake could be a gamble worth taking. Uber lost over $16 billion in the three years running up to its IPO. Since going public, it lost another $13 billion. By comparison, Lyft lost a measly $2.6 billion in 2019, but its business is based entirely in North America, while Uber is global.

Whatever money both companies will lose closing up shop in California could be pocket change compared to getting to rewrite the laws governing work in the state

Search Engine Optimization

SEO or Search Engine Optimization is a constantly evolving and volatile field. Google the largest search engine in the world has had its problems in recent years. In 2016 the search engine delisted Pay Day Loan companies listings.

Now it seems fake review sites are ranking high in the search engine. The problem is that these sites are giving great reviews to certain products and false negative reviews to the competition. This practice is rewarding scammers and content affiliate farms by ranking them based on keywords and content rather than actual products.

Ranking on the first page of Google organically is a way to increase a companies credibility, drive traffic, and sales. What happens when the websites details are hidden and fake review sites are listing higher than legitimate sites.

Google do not let anyone know the algorithm they use to list sites. There is a billion dollar business in just getting ranked in Google. SEO and SEM experts have online discussion about how to rank and what criteria Google is looking for.

In the online marketing world there is always Blackhat techniques, these are techniques used that are not industry defined and considered a bad practice. Think of all the spam emails you get and the robocalls as black hat. Whitehat is using best practices as a way to market products and services that stays clear of any unscrupulous activity.

Google is rewarding bad practices.

By allowing fake review sites to rank higher, especially in the CBD world, Google has let their guard down and let scammers raise for keywords and look legitimate.

If you are looking at review sites on Google or Youtube, please remember that the majority of these sites are affiliate sites, that is, they get a percentage of the profits of you click and buy on one of their links. There is nothing wrong with Affiliate sites, they are important and help build brands and businesses while helping people earn money.

How can legit companies compete when Google rewards bad actors

There have been many references to the issues with Google and its ranking system for review sites mentions of SEO journal and Webmaster forums going back to 2013. Indeed Amazon has had fake reviews on its site by sellers switching great reviewed cheap products for more expensive alternatives. A case where a company selling Apple watch chargers with 200 5 star reviews was flagged when it was found that the reviews were for another finger toy they had listed and swapped out.

CBD Review sites getting dirty how to trust Google

One of the most destructive patterns that will arise though Google not addressing this massive issue is many CBD products will receive bad reviews and negative feedback or just loose sales based on content farms. Will Google address the issue in time or shall it reward bad behavior and help to rank fake review sites over legitimate CBD sites and products.

Report fake review sites to Google

Reporting suspect reviews to Google Small Business support should be your next port of call if your initial flagging did not work. The response you get from flagging a review shouldn’t take more than a week. If, after this time, the review is still there, it’s time to contact Google My Business. You can do this by following these steps.

1. Log into your Google My Business page here: https://www.google.com/business/
2. Navigate to the Reviews section
3. Click the home menu, and then select Support
4. You can then select a preferred method of contact, either Phone or Email
5. You will be asked to fill in a few pieces of information. Attach a screenshot example of the suspect review and offer any further information you feel may be helpful.
6. Submit your complaint. You should hear back within 2 working days.

How an Audience found out Game Of Thrones is not real life.

This headline trending in social media and online shouldn’t have been “Game of Thrones” fans spot coffee cup during scene and Twitter couldn’t believe it ” it should have been “Unimaginative twit ruin things for everybody to get attention. “

Twitter can add more conspiracy theories to its list of bans as far as I am concerned. Sunday evening Shock and horror as a Starbuck cup was left in a scene.  Twitter and social media erupted as if this was the most shocking thing to happen to television since the shooting of JR. Most of the audience will have no recollection of those days.

Do we really need a social media outcry at everything. We currently have a President who uses it to bash people, and horses now too. The idea that everyone has a say and a voice is great, but sometimes it’s better to just say / tweet / post nothing.

Emotional investment in dragons and dire wolves

For those who have an emotional investment in dragons, dire wolves and the outcome of the Stark clan , please relax, it is all a scripted TV show. None of the actors really die. Its only their character on the hit show.  It’s a complex scripted show that has entertained audiences for years, unlike the other scripted reality shows on TV like the Kardashian clan. As such, things happen, props get left or a cup gets left on a table.

Twitter Erupts and Social Media Fans Abstain

We have had a lot to deal with recently. Markels “Endgame” left fans abstaining from social media in fear they would see leaked endings. Will Smith as the genie in Aladdin was heartbreaking and the new Star Wars trailer made some respond that it will never measure up to the Classic Star Wars trilogy, after seeing 37 second trailer.

Winterfell is not Real

If you need any convincing  that there is not real Winterfell and that its all just a show, please watch the amazing Gandolf himself, Ian Mckellen describe the process to a character portrayed Ricky Gervais in Extras.  This is hilarious !

I get it, in a world with political echo chambers, more presidential candidates than bad guys in a complete series of Scooby Doo, we need release. We are all on edge and we need to vent in any way.

We used to use our imagination, not CGI

Why can’t we just enjoy something on its merits. The original Star Trek, Twilight Zone was camp and as an audience we understood that Captain Kirk was not really on the hostile planet.  We used our imagination, not CGI. We played along and didn’t complain that it was not life like. Why now do we need to feed into this obsession with all things narcissistic ? Why do we now look at these characters as if they are real and talk about them like they are family?

Social Media has us looking to vindicate something, to point out the wrong or to prove we are right. Search any post by the President or his Clan and you will see this. Why do people have to find flaws.  Game of Thrones is an amazing series, “It had me at Hello”, but its entertainment, its fiction, its just a story.

I will be sorry that it is no longer running, and I will binge watch the series through-out the year., but I just wont take to social media to express my outrage, disgust or my concern over TV shows. I just turn them off, I have E! Entertainment blocked on my TV. I never have to complain about that trite, unfulfilling fluff.
