In a hearing held on September 13, 2021, Los Angeles Superior Court Judge Doreen Boxer <a href="https://investornews.io/wp-content/uploads/2022/02/Minute-Order-1806108171.pdf">granted Vargas’s anti-SLAPP motion</a> and <a href="https://investornews.io/wp-content/uploads/2022/02/Minute-Order-1806107598.pdf">denied Oshri’s civil harassment petition</a> for failure to sustain the applicable burden of proof. <h6 style="text-align: left;"><strong>Los Angeles (CA) –</strong> Self-described &#8220;successful&#8221; entrepreneur Hadari Oshri has made both an online and a business comeback.</h6>
<h6>After her long list of demonstrated <a href="https://investornews.io/hadari-oshri-300-million-ppe-fraud/" target="_blank" rel="noopener">business failures, including Xehar, Trade Safe Pro and Hadari Online</a>, the Israeli-American entrepreneur has finally launched her latest business website, <em>www.gayaventures.com</em>, an acquisitions and consulting firm combining AI and wellness that she&#8217;s started to publicize online.</h6>
<h6>Indeed, just this week <em>Nasdaq.com</em> released an article written by &#8220;guest contributors&#8221; referencing Oshri&#8217;s latest pet project. The author, Jenny Q Ta, sadly, got Oshri&#8217;s company name wrong&#8230;Luckily, we&#8217;re here to get it right. <em>Gaya</em>, not <em>Gava</em>.</h6>
<h4><strong>Why Gaya Ventures LLC now?</strong></h4>
<h6>Public records show that Gaya Ventures LLC was<a href="https://search.sunbiz.org/Inquiry/CorporationSearch/SearchResultDetail?inquirytype=OfficerRegisteredAgentName&amp;directionType=Initial&amp;searchNameOrder=OSHRIHADAR%20L220000837321&amp;aggregateId=flal-l22000083732-5e4b7e16-a111-4d94-9ba4-24853e37fc30&amp;searchTerm=Oshri%20%20%20%20%20%20%20%20%20%20%20%20%20%20%20Gal&amp;listNameOrder=OSHRIGAL%20L120001541770" target="_blank" rel="noopener"> formed by Hadar Oshri in Florida in 2022</a> following the demise of her partnership with LA-based conman <a href="https://investornews.io/marc-lubaszka-illegal-gold-mines-and-back/" target="_blank" rel="noopener">Marc Lubaszka</a>, who&#8217;s been under investigation by the FBI and the SEC for his involvement in alleged business schemes, including defrauding gold IRA investors across the country and trying to sell nonexistent PPE and imaginary private jets.</h6>
<h6>Court records and exclusive documents and <a href="https://investornews.io/marc-lubaszka-hadari-oshri-ppe-scheme-private-jets/" target="_blank" rel="noopener">testimonies obtained by this outlet</a> show that both Lubaszka and Oshri joined forces during the pandemic to sell nonexistent PPE through the former&#8217;s now-defunct private jet company: <a href="https://investornews.io/marc-lubaszka-hadari-oshri-ppe-scheme-private-jets/" target="_blank" rel="noopener">Fly Private X</a>.</h6>

<h6>Additionally, in 2021, Oshri filed and <a href="https://investornews.io/hadari-oshri-loses-anti-slapp/" target="_blank" rel="noopener">lost an embarrassing SLAPP case against</a> reporter Aitana Vargas in a desperate attempt to stop the publication of &#8220;<a href="https://investornews.io/the-expose-hadari-oshri-and-her-attorney-tried-to-stop-wins-la-press-club-award/" target="_blank" rel="noopener">A Special Report: The Harrowing Impunity of White-Collar Crime</a>,&#8221; a multi-part series that went on to <a href="https://investornews.io/the-expose-hadari-oshri-and-her-attorney-tried-to-stop-wins-la-press-club-award/" target="_blank" rel="noopener">win an LA Press Club award in 2022</a>. Oshri will have to pay mandatory attorney&#8217;s fees to the reporter for filing a frivolous case.</h6>

<h6>In 2022, Oshri and A1A Management, a corporation she co-managed with entrepreneur Patrick Seller, aka the &#8220;Crypto King,&#8221; were <a href="https://investornews.io/hadari-oshri-sued-pat-seller/" target="_blank" rel="noopener">sued for $250.000</a> for failure to deliver promised PPE. In their social media accounts, both Oshri and Seller bragged about the beachfront Malibu property they held parties at. Photos of them together have been deleted since.</h6>
<h6>According to Oshri&#8217;s public IG account, the Malibu parties continue to this date&#8230;</h6>
<h4><strong>Who&#8217;s behind Gaya Ventures?</strong></h4>
<h6>According to the company website (https://www.gayaventures.com), four people may be involved in the project. Oshri is listed as the CEO, whereas Gregory Witherspoon (Oshri&#8217;s former Xehar investor, who withdrew his support following widespread mismanagement claims by former workers and contractors) is listed as the company CFO. Witherspoon&#8217;s LinkedIn profile names Plan Bravo Partners as his most recent position and makes no mention of Gaya Ventures. Then, there&#8217;s realtor Darla Stuart, whose <a href="https://www.linkedin.com/in/darla-stuart-355890130/" target="_blank" rel="noopener">LinkedIn profile</a> mentions the company. Lastly, the site lists <a href="https://www.dea.gov/sites/default/files/divisions/stl/2009/stlouis061609p.html" target="_blank" rel="noopener">Orlando Birbragher</a> –a Florida-based businessman born to Panamanian parents– as the CIO.</h6>

<h6>According to court records, Birbragher <a href="https://www.casemine.com/judgement/us/5914b375add7b049347663f0" target="_blank" rel="noopener">was ordered detained without bond in 2007</a> pending the resolution of criminal matters in a 31-count indictment, which included charges for conspiracy to distribute drugs through his company, Pharmacom.</h6>
<h6><a href="https://caselaw.findlaw.com/court/us-8th-circuit/1519909.html" target="_blank" rel="noopener">2010 court documents state</a> that &#8220;Orlando Birbragher conditionally pled guilty to conspiracy to distribute controlled substances, in violation of 21 U.S.C. §§ 841(a)(1), 841(b)(1)(D), 841(b)(1)(D)(2), 846, 856(a)(1), and 861(a)(1), and conspiracy to launder money from the drug conspiracy, in violation of 18 U.S.C. §§ 1956(a)(1)(A)(i), 1956(a)(1)(B)(i), 1956(h), and 1957. The district court sentenced Birbragher to 35 months imprisonment to be followed by a two-year term of supervised release. The court also entered a preliminary forfeiture order of $2,465,209.92.&#8221;</h6>
<h6>In 2010, the <a href="https://ecf.ca8.uscourts.gov/opndir/10/04/084004P.pdf" target="_blank" rel="noopener">8th Circuit of the US Court of Appeals</a> denied Birbragher&#8217;s request to dismiss his indictment.</h6>

Bienvenu on <a href="https://orlandobirbragher.medium.com/" target="_blank" rel="noopener">Medium</a> claim that the businessman <a href="https://orlandobirbragher.medium.com/orlando-birbragher-beyond-pharma-an-initiative-by-orlando-birbragher-e9c63afc6ddc" target="_blank" rel="noopener">was exonerated</a>.</h6>
<h6>Fast forward to 2022, and Birbragher and his companies, including BBV International Consulting, were <a href="https://trellis.law/doc/117625921/complaint-efiled-petition-for-injunctive-relief" target="_blank" rel="noopener">sued for civil theft</a>.</h6>
<h4><strong>Hadari Oshri has acquired two Instagram accounts with fake/bought followers</strong></h4>
<h6>To obtain clout and notoriety, one of Oshri&#8217;s latest acquisitions is her @hadari_oshri_israel Instagram account, featuring over 10.6K followers. This impressive accomplishment is, however, followed by an even more impressive one, @gaya_ventures, an Instagram account with over 7.4K followers, four posts and a handful of likes.</h6>
<h6>It all looks like a fresh, promising start for the entrepreneur.</h6>
<h6>At the time of this publication, Mr. Witherspoon has not replied to a media request for comments.</h6>

<h6><strong>Los Angeles (CA)</strong> – Probably 2021 was not a year for the books for Hadari Oshri. And things aren&#8217;t looking up in 2022 either.</h6>
<h6>Last year, the American-Israeli entrepreneur lost her meritless restraining order case against me. My anti-SLAPP court win was a powerful reminder of why First Amendment Rights are celebrated, honored and protected by Americans. And as an American citizen, Oshri should have known better. But she didn&#8217;t.</h6>

<h6>That I prevailed on my anti-SLAPP motion forced Oshri to learn the hard way. She will have to pay my <a href="https://investornews.io/hadari-oshri-loses-anti-slapp-court-battle/" target="_blank" rel="noopener">hefty legal fees</a> ($23,000). Additionally, in the past months, I&#8217;ve released the<a href="https://investornews.io/marc-lubaszka-illegal-gold-mines-and-back/" target="_blank" rel="noopener"> investigative series</a> that she desperately tried to silence. And her sloppy <a href="https://investornews.io/hadari-oshri-expert-ppe-during-pandemic/" target="_blank" rel="noopener">PR efforts</a> to deliver an online campaign aimed at clearing her name&#8230;miserably failed.</h6>
<h6>But today, I don&#8217;t want to focus so much on Oshri. Rather, I want to do some introspection.</h6>
<h6>To get this far, I had to spend the summer of 2021 fully immersed in time-consuming legal efforts to fight her frivolous restraining order. Because let&#8217;s be clear about one thing: Oshri, <a href="https://investornews.io/the-legal-bullies-club-hadari-oshri/" target="_blank" rel="noopener">like every other SLAPPer</a>, never intended to win in court. She intended to bully me into silence in the same way she used <a href="https://youtu.be/UN8bJb8biZU" target="_blank" rel="noopener">fear tactics</a> in the past to silence her victims&#8217; plights and grievances.</h6>
<h6>In early 2021, Oshri retained the legal services of LA-based attorney John Tamborelli in order to <a href="https://investornews.io/aitana-vargas-expose-on-hadari-oshri-nominated-for-journalism-award/">stop my investigative efforts</a>. Around February 14th that year (a very symbolic date for Oshri and her high-caliber restraining order team of criminal defense attorneys), Tamborelli sent me a &#8220;cease and desist&#8221; letter, or as Oshri called it in her legal petition against me a <a href="https://investornews.io/hadari-oshri-loses-anti-slapp-court-battle/" target="_blank" rel="noopener">&#8220;seance&#8221; and &#8220;disease.&#8221;</a></h6>
<h6>Realizing that the &#8220;seance&#8221; and &#8220;disease&#8221; strategy had failed, Tamborelli tried yet another trick: He had one of my sources &#8220;instruct&#8221; me to remove any and all media coverage that I&#8217;d posted online mentioning him, Oshri and Marc Lubaszka.</h6>

<h6>Of course, I refused to comply. But more importantly, the National Writers Union (NWU) sent Tamborelli a letter demanding that he stop all intimidation attempts towards me. And&#8230;he stopped.</h6>

<h6>If anything, I have come out of this experience understanding the many ways in which I must express my gratitude towards Hadari Oshri. She turned me into quite an expert on anti-SLAPP motions and meritless First Amendment Right cases. For three months last year, I was the anti-SLAPP motion version of the cookie monster. Like a maniac, I devoured legal cases, rulings and opinions by the CA lower courts, the Court of Appeals and the CA Supreme Court. Every case I found –even in other states or the US Supreme Court–, I read and carefully studied.</h6>

The attempted deals also connect to <strong>Arael Doolittle</strong>, later sentenced in a federal PPE fraud case. Oshri sought a restraining order to stop this series; a Los Angeles Superior Court judge <strong>dismissed her petition under California&#8217;s anti-SLAPP law</strong> on September 13, 2021 and awarded the reporter her fees. <p style="text-align: center;"><em>AN IMPORTANT NOTE:</em> <em>On June 22, 2021, Hadari Oshri –Marc Lubaszka’s business partner– filed a civil harassment restraining order (CHRO) against Investor News reporter Aitana Vargas to stop the publication of her investigative series <a href="https://investornews.io/marc-lubaszka-illegal-gold-mines-and-back/" target="_blank" rel="noopener">“A Special Report: The Harrowing Impunity of White-Collar crime,”</a> and any subsequent installments or future media coverage. On August 3, 2021, Vargas filed an <a href="https://investornews.io/hadari-oshri-loses-anti-slapp/" target="_blank" rel="noopener">anti-SLAPP motion to strike Oshri’s CHRO petition</a>. In a hearing held on September 13, 2021, Los Angeles Superior Court Judge Doreen Boxer <a href="https://investornews.io/wp-content/uploads/2022/02/Minute-Order-1806108171.pdf">granted Vargas’s anti-SLAPP motion</a> and <a href="https://investornews.io/wp-content/uploads/2022/02/Minute-Order-1806107598.pdf">denied Oshri’s civil harassment petition </a>for failure to sustain the applicable burden of proof. CA’s powerful anti-SLAPP statute demands that the prevailing defendant be granted attorney’s fees for filing a frivolous case. The Israeli entrepreneur also declined to go on a recorded interview or provide statements via email.</em></p>

<p><strong>Los Angeles, CA</strong> – As rapper Dylan Raw took on management roles at both <a href="https://buy-gold-brightly.myshopify.com/" target="_blank" rel="noopener">Buy Gold Brightly</a> and Fly Private X, and Marc Lubaszka’s imaginary assistant –Krista Collinsworth– stayed busy recruiting personnel for a private jet company with no jets, around 2020, the runaway broker welcomed a new entrepreneur to his team: Hadari Oshri, a 40-year-old from Israel with a wake of business casualties marching her path, including her many unpaid fashion fairies and ex-contractors from her signature yet defunct pet project: <a href="https://opencorporates.com/companies/us_ca/C4046846" target="_blank" rel="noopener">Xehar</a>.</p>

<p>Initially, the Lubaszka-Oshri axis may have seemed like the perfect business marriage. With his reputation tarnished by his previous gold scam, Lubaszka would be the brains of the new partnership and remain in the background. Meanwhile, Oshri –with her mini-skirts, oversized shades and guffawed laugh– would be the front person in charge of closing face-to-face deals with investors and clients. Despite their demonstrated history of defunct businesses, they must have thought that, together, they could rise above their many failures to build an empire from scratch, create a new army of fictional business characters and put their audacity and talent to work. All towards their ultimate goal: To make hundreds of millions of dollars by trying to sell PPE and private jets –or “jests,” as Oshri baptized them in court documents.</p>
<p>Indeed, their partnership seemed to be as timely as convenient. As COVID-19 ravaged countries and left a trail of desolation and deaths worldwide, some last-minute entrepreneurs were already capitalizing on other people’s desperation and suffering by promising to supply and <a href="https://www.consumer.ftc.gov/blog/2020/08/scammy-ppe-sellers-exploit-covid-19-fears" target="_blank" rel="noopener">ship by a certain date</a> medical equipment they didn&#8217;t possess. And Lubaszka and Oshri needed to act quickly if they didn’t want to miss out on this rare opportunity.</p>
<p>“She wants to get on the bandwagon of whatever she thinks is selling,” says curvy model Cheyenne Lee, who worked for Oshri’s Xehar fashion fairy company until it came crashing down in the Fall of 2018. “I can already hear her voice in my head like ‘Oh my God! We are gonna make so much money! The pandemic is the greatest thing that ever happened, we are about to be rich!”</p>
<p>Seemingly unconcerned that <a href="https://www.ic3.gov/Media/Y2020/PSA200320" target="_blank" rel="noopener">law enforcement agencies</a> had stepped up their <a href="https://www.justice.gov/coronavirus" target="_blank" rel="noopener">efforts</a> to aggressively prosecute <a href="https://www.justice.gov/coronavirus/combattingfraud" target="_blank" rel="noopener">fraudulent COVID-19 schemes</a>, Fly Private X was ready to dive bomb into their newest illicit endeavor in an attempt to hit the PPE jackpot. And what better place to ride the lucrative wave of multimillion-dollar PPE sales than a luxurious beachfront property located in East Malibu –from where Hadari Oshri and Lubaszka were running their joint schemes for months, as shown by company filings, court documents and even one text message that, surprisingly, Oshri volunteered to me via email.</p>
<h3 style="text-align: center;"><strong>Lubaszka&#8217;s and Oshri&#8217;s business ties to sentenced PPE fraudster Arael Doolittle  </strong></h3>
<p>Around June 30, 2020, Alaa Hattab, CEO of Canada-based Saniton Corporation, was awaiting a shipment of 10 million medical examination quality nitrile gloves from Fly Private X that never materialized.</p>

<p>The attempted $124.5M transaction was detailed in a <a href="https://investornews.io/wp-content/uploads/2022/02/Hadari-Email-with-1-PO-e1645663474366.jpg" target="_blank" rel="noopener">PO (<em>purchase order)</em></a> that Hattab had sent to Lubaszka’s private jet company. Dissatisfied with the services rendered, Hattab referred to the Fly Private X team as “sketchy” and accused them of not having the PPE items they were trying to sell.</p>
<p>“The PO you (Aitana) are talking about was not completed. We were representing a client and sent a PO on the basis that they were buying from us. We were intermediaries in the transaction,” said Hattab in an email to me. “There was no product and the whole thing was a waste of time. Never proof of stock, always delays in getting us any sort of verification for products. It was a complete waste of time.”</p>
<p>Also on June 30, 2020, the now sentenced energy executive Arael Doolittle sent a PO to Fly Private X ordering 20 million boxes of nitrile gloves. But the jet company failed to deliver the PPE supplies, for which it was trying to collect $248M. Named in the PO was Bill Underwood, Doolittle’s attorney, who confirmed that the sale had gone South.</p>
<p>“I was involved in this transaction and it was not completed, which is the case with most of the PPE transactions that I have seen,” Underwood said in an email.</p>
<p>Although Doolittle’s attorney seemed to go easy on Oshri and Lubaszka for failing to deliver the promised PPE items, the POs that both his client and Hattab issued to Fly Private X contained misleading information: Both documents listed <a href="https://opencorporates.com/companies/us_ca/C4046846" target="_blank" rel="noopener">Oshri&#8217;s old Xehar warehouse</a> in El Segundo (California) as the jet company’s offices. However, Oshri’s warehouse was vacated a few years ago and she no longer had ties to those offices. Neither did Lubaszka. It was, simply put, a smoke screen.</p>

<p>While no charges have been filed against Marc Lubaszka and Hadari Oshri for their dubious PPE operations, the POs obtained by this outlet also raise questions about the bigger role that the jet company and its representatives might have potentially played in a more elaborate PPE scheme across national and international borders.</p>
<p>In the meantime, in November 2020, Doolittle’s luck ran out. The businessman was charged with PPE fraud by the US Department of Justice for attempting to sell 50M nonexistent N95 masks to the Australian government. The fraudulent $317M transaction never materialized.</p>
<p>Doolittle pleaded guilty to wire fraud charges in 2021 and was ordered to serve a 54-month sentence in federal prison on February 16, 2022. As Judge Lynn N. Hughes handed down <a href="https://www.justice.gov/usao-sdtx/pr/local-man-sentenced-317-million-n95-mask-scam" target="_blank" rel="noopener">the sentence</a>, he highlighted that despite “no actual financial loss in this case, there are still costs associated with cases like this that victims of frauds suffer.”</p>
<p>Judge Hughes’s opinion on PPE fraud is also echoed by other legal experts. According to a column published on the <a href="https://www.natlawreview.com/article/ppe-fraud-rise-during-coronavirus-pandemic" target="_blank" rel="noopener">National Law Review site by Dr. Nick Oberheiden</a>, a federal attorney who has defended clients in PPP loan fraud cases and COVID-19 investigations, PPE fraud can be construed as “promising to supply medical equipment or goods that the sellers do not have in order to capitalize on societal fear and make a profit at the expense of the emotional public sentiment.”</p>
<h3 style="text-align: center;"><strong>Hadari Oshri volunteered the POs linking both her and Fly Private X to a potential PPE scheme</strong></h3>
<p>When the news on Doolittle’s arrest broke in the Fall of 2020, it didn’t come as a surprise to Fergal Furlong, who already had first-hand knowledge that Oshri –with whom he had a contentious professional relationship at Xehar– had teamed up with Lubaszka in various ventures and that the 44-year-old gold broker had become her meal ticket.</p>
<p>In an exclusive interview at the beginning of 2021, Furlong explained that, around June 2020, Oshri was looking to hire a writer capable of placing promotional <a href="https://investornews.io/wp-content/uploads/2022/04/hadari-oshri-fly-private-x-fraud-lubaszka-jets-FORBES.jpg" target="_blank" rel="noopener">articles about Fly Private X</a> in Forbes. But eventually, it also became clear to him that she played a key role in the jet company’s multimillion-dollar PPE operations. And it was Oshri who volunteered this information to Furlong.</p>
<p>Throughout 2020, Furlong demanded that Oshri start making payments as part of a $200K defamation and breach of contract settlement agreement that they had signed. To prove that she’d soon have the financial muscle to pay him, Oshri emailed him three POs totaling over $400M in attempted PPE sales that she claimed to be &#8220;working on&#8221; on behalf of Fly Private X. But the PPE sales were never completed, she failed to make any settlement payments and further tension set in between them.</p>
<h3 style="text-align: center;"><strong>Marc Lubaszka posed as an alleged attorney</strong></h3>
<p>Then, around June 2020, Furlong received an unexpected call from an alleged attorney who identified himself as “Marc,&#8221; wanted to clear the air and facilitate a payment plan between Oshri and Furlong. About two weeks later, Furlong and Marc met in a hotel in the oceanside city of Marina del Rey.</p>
<p>“Marc showed up dressed in a suit, wearing sandals and visibly drunk,” Furlong explained. “He looked like a complete mess.”</p>
<p>The self-proclaimed attorney stated that Oshri was broke, and instead of providing a payment plan, he offered Furlong multiple partnership opportunities that ranged from selling private jets to setting up gold websites and trading options. The meeting, however, ended abruptly when Furlong pulled out his phone and asked Marc about one of the POs that he’d received from Oshri showing Fly Private X’s involvement in attempted PPE sales.</p>
<p>“Marc just got up, then looked at me for a second, said he had to go and walked outside,” Furlong explains. “I had to pick up the breakfast tab.”</p>
<p>Minutes later, Furlong walked to the parking lot and headed to his car. “Marc was walking around, approached me and said: ‘You can’t be doing well if you’re driving that car.’”</p>
<p>This was the last time they saw each other. Yet blatantly unaware of how poorly the meeting had gone, Marc texted Furlong the same day to see how they could “work together” and asked for any correspondence between them to be delivered via email to his imaginary assistant, Krista Collinsworth, who responded to Furlong’s emails from a Fly Private X account, according to documents I had access to.</p>
<p>But by then, it was too late. Furlong had finally confirmed that the alleged attorney was small businessman Marc Lubaszka, and that he&#8217;d been working with Oshri for months.</p>
<p>“When I confronted him about his identity, Marc hung up on me, then called me a few minutes later and insisted that he was Marc Anderson,” Furlong explains.</p>
<p>By inventing a new persona, Lubaszka had just added another alias to the long list of pseudonyms and assumed personalities that he has used over the years to disguise his identity: From David to Anthony Cohen, Andrew Stevens, Scott Mason, British financier Jason Butler and deceased German-American philosopher Herbert Marcuse.</p>
<p>Indeed, in 2018, Marcuse must have risen from the dead to publish an ecstatic article on Medium to perpetuate the myth that Lubaszka had built a $100M real estate empire in Venezuela –a country the gold dealer survived in 2012 thanks to the humanitarian aid and free assistance provided by <a href="https://investornews.io/marc-lubaszka-illegal-gold-mines-and-back/">Venezuelan-Italian pastor Rubén Turtulici</a> and his religious network. Needless to say, Marc Lubaszka’s piece, an obvious PR attempt to clear his name, was removed by Medium months ago.</p>

<p>Legally recorded phone conversations between Furlong and Oshri that I had access to before March 2021 show that the origin and authenticity of the POs was a highly contested topic between them in the summer of 2020.*</p>
<p>When Furlong pushed Oshri for honest answers, doubted the nature of the documents and raised questions about potential fraud, the Israeli entrepreneur stated that she had “made up” the POs in an attempt to get him off her back by showing that, as soon as she completed several multimillion-dollar transactions, she&#8217;d be able to pay him.</p>
<p>In the audio recordings, Oshri also claimed that she named <a href="http://flyprivatex.com/" target="_blank" rel="noopener">Fly Private X</a> on the POs because she “had to use a company name” and decided to list Lubaszka’s private jet company.</p>
<p>Oshri’s remarks above, however, contradict those made by Hattab and Doolittle’s attorney, who confirmed to me that the POs listing Fly private X&#8217;s attempted multimillion-dollar PPE transactions were, indeed, authentic.</p>
<h3 style="text-align: center;"><strong>Hadari Oshri&#8217;s PPE version in the recordings is not supported by her own PR campaign</strong></h3>
<p>More importantly, the version Oshri provided in the recordings is not supported by her own self-promotional claims in articles published in <a href="https://medium.com/@hadari.oshri" target="_blank" rel="noopener">2021</a> on several digital outlets, in which she portrayed herself as an expert on global supply chain and a successful PPE businesswoman.</p>

<p>“When the pandemic hit, she (Hadari Oshri) saw an opportunity to sell PPE,” says a <a href="https://investornews.io/wp-content/uploads/2022/02/hadari-oshri-ppe-articles-pr-marketing.png">story published</a> on <em>The Inscriber Magazine,</em> her <a href="https://medium.com/@hadari.oshri" target="_blank" rel="noopener">Medium</a> account and her website. The article, written by her ghostwriter, Ryan Foland, went on to say that Oshri “has pivoted to helping hospitals and other organizations source much-needed medical supplies and PPE from suppliers around the world.”</p>
<p>A second piece authored by the Israeli businesswoman –yet written by <a href="https://investornews.io/hadari-oshri-expert-ppe-during-pandemic/">Foland</a>– that appeared in 2021 on <em>Disrupt Global, </em>her <a href="https://medium.com/@hadari.oshri" target="_blank" rel="noopener">Medium</a> account and <a href="http://www.hadarioshri.com/blog/" target="_blank" rel="noopener">her website</a> stated that:</p>
<p>“Over the last year, in a world impacted by a global pandemic, I have seen buyers circumventing their brokers. I have heard clearly that sellers are not being 100% loyal to their brokers… I have seen people present sellers that are not sellers. Examples of this and other problems are common in the many PPE deals during the pandemic that blew up and never closed.”</p>
<p>Unsurprisingly, nowhere in these articles does Oshri mention that Hattab and convicted PPE fraudster Doolittle never received the supplies that she claimed to possess and tried to sell for over $370 million.</p>
<p>But in her desperate effort to dictate and impose her own PPE narrative, Oshri may have made a fatal mistake. In a legally recorded phone conversation with Furlong, she delivered statements that could potentially trigger criminal liability for the Israeli entrepreneur: That she was aware that she had committed PPE “fraud” and that she knew it was “wrong.”</p>
<p>“In an attempt to hide Marc’s involvement, defend her business partner and avoid any potential investigation into him and his dealings, she told me that she made up the POs. But she didn’t. They were real,” Furlong explains.</p>
<h3 style="text-align: center;"><strong>Victims still waiting for justice</strong></h3>
<p>The POs that Oshri volunteered to Furlong amount to over $370M –an amount significantly higher than the $317M worth of nonexistent PPE that Doolittle fraudulently attempted to sell to a foreign government, for which he was criminally charged and recently ordered to serve a 54-month <a href="https://www.justice.gov/usao-sdtx/pr/local-man-sentenced-317-million-n95-mask-scam" target="_blank" rel="noopener">sentence</a> in federal prison.</p>
<p>Why Lubaszka and Oshri remain untouched is a question that only law enforcement can answer, but one that lingers to this date and that, for years, their many victims have demanded to know.</p>
<p>“I just want to see some form of justice,” regrets Gern. “After so many years, you start losing all hope. How come these guys don’t get caught and prosecuted? What else needs to happen?”</p>
<p>Gern’s sentiment is also shared by other victims of Lubaszka. 78-year-old David Coonrod, who lost over $17,000 with the gold broker nearly ten years ago, is still hopelessly awaiting some form of closure.</p>
<p>“Your publication (Aitana) may be the only satisfaction any of us ever receive,” he regrets.</p>

<p><em>AN IMPORTANT NOTE: On June 22, 2021, Hadari Oshri –Marc Lubaszka’s business partner– filed a frivolous civil harassment restraining order (CHRO) against me to stop the publication of my investigative series <a href="https://investornews.io/marc-lubaszka-illegal-gold-mines-and-back/" target="_blank" rel="noopener">“A Special Report: The Harrowing Impunity of White-Collar crime,”</a> and any subsequent installments or future media coverage. On August 3, 2021, I filed an <a href="https://investornews.io/hadari-oshri-loses-anti-slapp/" target="_blank" rel="noopener">anti-SLAPP motion to strike Oshri’s CHRO petition</a>. In a hearing held on September 13, 2021, Los Angeles Superior Court Judge Doreen Boxer <a href="https://investornews.io/wp-content/uploads/2022/02/Minute-Order-1806108171.pdf">granted my anti-SLAPP motion</a> and <a href="https://investornews.io/wp-content/uploads/2022/02/Minute-Order-1806107598.pdf">denied Oshri&#8217;s civil harassment petition</a> for failure to sustain the applicable burden of proof. Oshri will now have to pay my attorney’s fees for filing a frivolous case. She also declined to go on a recorded interview or provide statements via email. And what follows are the next installments of my months-long investigative series whose publication Oshri desperately attempted yet failed to stop.</em></p>

<h2 style="text-align: center;"><strong>Dylan Raw heads Marc Lubaszka&#8217;s questionable private jet company and newest gold venture</strong></h2>
<p><strong>Los Angeles, CA</strong> – As the COVID-19 pandemic claimed victims all over the world, conman Marc Lubaszka took to the streets of America to recruit co-conspirators capable of helping him to run his sophisticated private jet and gold coin business operations. But, surprisingly, he didn’t get the best nor the most sophisticated players in the game. Instead, he enlisted a Texas-based rapper in his early twenties trying to make it big in the entertainment industry and with no experience as a business executive: Dylan Rottkov, known by the stage name of <a href="https://www.facebook.com/DylanRawMusic" target="_blank" rel="noopener">Dylan Raw</a>.</p>

<p>Around mid-April 2021, following several media requests that Raw had ignored from me earlier this year, the rapper finally called me and engaged in a heated, contentious and bizarre on-the-record interview about his participation in Lubaskza’s schemes.</p>
<p>“You’re probably the reason why I took down the information on Fly Private X from my Instagram account!” he lashed out at me in an attempt to deflect any responsibility.</p>
<h3 style="text-align: center;"><strong>Despite learning of Marc Lubaszka&#8217;s 2012 gold scam, Dylan Raw continues to partner with him </strong></h3>

<p>Raw confirmed that he knew about Lubaszka’s previous gold scam but explained it away by stating that it had happened a decade ago and he had nothing to do with it. As the singer played down the conman’s tumultuous past, he stated he had joined Fly Private X to capitalize on a “lucrative industry,” make good money in a few months if he sold a private jet and become the hallmark for success.<em> </em></p>
<p>He denied brokering any deals or selling any planes or gold, and underscored that he wanted to send a positive message to the world, despite photos of him holding firearms and rolling weed in multiple public Instagram posts that have since been removed.</p>
<p>But Raw’s participation in Lubaszka’s enterprises doesn’t end here. Public records also show that the hip-hop artist from Long Island is listed as an officer in the conman’s new gold company –Buy Gold Brightly–, which was created in Montana in February 2021 under a 14-year-old shelf corporation: Gold Title, Inc. A day after the company was registered, former model Patrick Seller replaced Raw.</p>
<p>Furthermore, Buy Gold Brightly looks like a clone of Lubaszka’s defunct Aurum Advisors and Gold Coins Gain, and it seems to have picked up its coin investment operations where the former two fraudulent companies left off a decade ago.</p>

<p>“I paid $12 for the gold WordPress site and maybe that’s why they put my name on the company (Buy Gold Brightly),” <a href="https://twitter.com/DylanRawMusic?ref_src=twsrc%5Egoogle%7Ctwcamp%5Eserp%7Ctwgr%5Eauthor" target="_blank" rel="noopener">Raw</a> said as he dodged my multiple attempts to have him confirm or deny if he’d consented to being listed on the gold company’s official filings.</p>

<p>“I’m not a victim (of Lubaszka),” he stated several times, making it clear that he was a willing participant in the conman’s business operations. “I’ll continue to take your calls and give you insights if you keep my name anonymous,” he said even though we’d agreed that the interview was on the record, and I had clearly stated that I was taking notes of everything he said.</p>
<p>While willing to throw Lubaszka and Hadari Oshri under the bus to save himself, as of mid October 2021, <a href="https://twitter.com/DylanRawMusic?ref_src=twsrc%5Egoogle%7Ctwcamp%5Eserp%7Ctwgr%5Eauthor" target="_blank" rel="noopener">Raw</a> was still following both of his controversial business partners on Instagram –a sign, one could conclude, that the rapper is still Lubaszka’s official patsy.</p>

<p>Until recently, Buy Gold Brightly had two divisions: A site that referred visitors to gold dealers nationwide –which was taken down in the weeks following my interview with Raw– and a Myshopify site that allows consumers to purchase coins and invest in gold IRA plans.</p>

<h3 style="text-align: center;"><strong>Dylan Raw&#8217;s &amp; Lubaszka&#8217;s </strong><strong>Buy Gold Brightly makes misleading claims</strong><strong><br />

<p>A simple look at Buy Gold Brightly’s Myshopify site reveals highly dubious information: The toll-free number listed for consumers to reach Lubaszka’s and Raw’s team rings to the <a href="https://www.ifcj.org/who-we-are/about-ifcj" target="_blank" rel="noopener">International Fellowship of Christians and Jews</a>, who were stunned to hear over the phone that the company is misusing their phone number.</p>
<p>The brokerage site also identifies its trading offices on the 11th floor at 1999 Avenue of the Stars in Los Angeles and “celebrates” having achieved $3.4bn in sales as of the company’s 14th anniversary. However, Buy Gold Brightly was only created earlier this year, not 14 years ago, and the company managing the virtual suites on the 11th floor has not confirmed that Lubaszka is one of its tenants. Simply put, the gold scheme is just one of Lubaszka’s deceiving signature tricks.</p>
<p>In December 2022, the State involuntarily cancelled the company. Seller was the principal of record when it died.</p>

In a hearing held on September 13, 2021, Los Angeles Superior Court Judge Doreen Boxer <a href="https://investornews.io/wp-content/uploads/2022/02/Minute-Order-1806108171.pdf">granted Vargas&#8217;s anti-SLAPP motion</a> and <a href="https://investornews.io/wp-content/uploads/2022/02/Minute-Order-1806107598.pdf">denied Oshri’s civil harassment petition</a> for failure to sustain the applicable burden of proof. Oshri will now have to pay Vargas&#8217;s attorney’s fees for filing a frivolous case. The Israeli entrepreneur also declined to go on a recorded interview or provide statements via email. This outlet has striven to reach out to sources to ensure they have the opportunity to provide their own account of events.</em></p>
<h3 style="text-align: center;"><strong>Hadari Oshri falsely accused award-winning news correspondent Aitana Vargas of being &#8220;a very dangerous woman&#8221; and a &#8220;corrupted reporter&#8221; in embarrassing legal petition<br />

<h6><strong>California</strong> – Self-proclaimed “successful” entrepreneur Hadari Oshri is not as legally untouchable as she probably thought she was. And she’s officially joined the ‘Legal Bullies Club’ for misusing California’s court system in a desperate attempt to silence a news correspondent and try to prevent the full publication of an investigative series: “<a href="https://investornews.io/marc-lubaszka-illegal-gold-mines-and-back/">A Special Report: The Harrowing Impunity of White-Collar Crime.&#8221;</a></h6>
<h6>By filing a frivolous restraining order against journalist <a href="https://aitanavargas.com" target="_blank" rel="noopener">Aitana Vargas</a> and losing the <a href="https://investornews.io/wp-content/uploads/2021/11/Notice-of-Ruling.pdf" target="_blank" rel="noopener">anti-SLAPP court battle</a> on September 13, Oshri became a member of the exclusive SLAPPers club, widely referred to as legal bullies who try to intimidate, silence and harass their critics exercising their rights of free speech on an issue of public interest or to communicate with the government.</h6>

<h6>Whether Oshri will be nominated for the <a href="https://protecttheprotest.org/2021/09/21/presenting-the-third-annual-slappies-awards/" target="_blank" rel="noopener">SLAPPies awards</a>, which dishonor 2021’s most illustrious legal bullies, remains to be seen. But she seems to be <a href="https://investornews.io/wp-content/uploads/2022/02/Minute-Order-1806108171.pdf" target="_blank" rel="noopener">an accomplished candidate</a> to be nominated in this year’s edition, especially after falsely accusing Vargas of being a &#8220;very dangerous woman&#8221; and a &#8220;corrupted reporter.&#8221;</h6>
<h6><a href="https://anti-slapp.org/what-is-a-slapp" target="_blank" rel="noopener">SLAPPs</a>, or &#8220;Strategic Lawsuits Against Public Participation,&#8221; are often brought by millionaires, corporations with unlimited resources and other powerful interests against activists, critics, journalists and consumers.</h6>
<h6>However, what sets Hadari Oshri apart from most of her fellow SLAPPers is that she neither leads a powerful corporation nor is the successful entrepreneur she claims to be. Indeed, in court documents, she confessed that all of her past companies went out of business. The part that she forgot to mention is that she owes a bunch of money to a bunch of people.</h6>
<h4 style="text-align: center;"><strong>Journalists may invoke anti-SLAPP protections when targeted by SLAPPers</strong></h4>
<h6>According to the <a href="https://www.rcfp.org/resources/anti-slapp-laws/" target="_blank" rel="noopener">Reporters Committee for Freedom of the Press (RCFP)</a>, “in terms of reporting, news organizations and individual journalists can use anti-SLAPP statutes to protect themselves from the financial threat of a groundless defamation case brought by a subject of an enterprise or investigative story.”</h6>
<h6>California’s <a href="https://www.buchalter.com/wp-content/uploads/2017/06/The-Nuts-and-Bolts-of-Anti-SLAPP.pdf" target="_blank" rel="noopener">anti-SLAPP statute</a> is considered one of the strongest in the country. It can also be invoked to strike a restraining order and entitles a prevailing defendant to an award of attorney’s fees.</h6>
<h6>But anti-SLAPP protections can also be invoked by activists, consumers and citizens exercising First Amendment rights on issues of public interest in a public forum, which may include social media posts, street protests and Yelp reviews.</h6>
<h4 style="text-align: center;"><strong>A $23K judgment against Hadari Oshri expected soon</strong></h4>
<h6>Indeed, according to a memorandum of costs that recently landed on the desk of Los Angeles County Superior court Judge Doreen Boxer, Oshri would have to pay the news reporter’s legal costs: A whopping $23,000.</h6>

And while the reporter declined to comment on the potential judgment, she stated that “I’d rather just let the series speak for itself. Readers will soon have the opportunity to learn about Hadari’s business practices and draw their own conclusions.”</h6>
<h6>“No doubt Hadari needs a crash course on constitutionally protected speech and the First Amendment. More importantly, I had publicly stated that I&#8217;d file an anti-SLAPP motion if she continued her intimidation campaign against me and her victims. She ended up taking me to court and was met with an anti-SLAPP,” the reporter added.</h6>

<h6>According to court documents, during 2021, the Spaniard was pressured multiple times into quitting her investigative work. <em>Investor News</em> had access to a <a href="https://investornews.io/wp-content/uploads/2022/03/hadari-oshri-john-tamborelli-legal-bullies-cease-and-desist-fraud-ppe_1.jpg" target="_blank" rel="noopener">cease</a>-and-<a href="https://investornews.io/wp-content/uploads/2022/03/hadari-oshri-john-tamborelli-ppe-scam-cease-desist_2.jpg" target="_blank" rel="noopener">desist</a> email that Oshri&#8217;s former attorney, John Tamborelli, sent her in February 2021 demanding that she stop reaching out and talking to sources. The email also threatened legal action against the reporter and one of her sources did they fail to comply.</h6>
<h6>Tamborelli was following orders from Oshri, whose email featured some memorable statements to the reporter and her source:</h6>
<h6><em>&#8220;You (Aitana) are putting your hands in places that is not belong to you !!!!!</em></h6>
<h6><em>You (Aitana) GOT to stop !!!!!</em></h6>
<h6><em>Also you you cucumber !!&#8221;</em></h6>

<h6><em>You are crossing all the lines</em></h6>
<h6><em>Where should I serve your lawsuit Ariana</em></h6>
<h6><em>And Qucomber !!&#8221;</em></h6>
<h6>The journalist didn&#8217;t reply to any emails that Oshri and Tamborelli sent that day.</h6>
<h6>Exclusive documents obtained by this outlet also show that in June 2021, Tamborelli wanted one of Vargas&#8217;s sources (Fergal Furlong) to instruct her to remove all the information related to Oshri or Tamborelli and any articles mentioning Tamborelli, Oshri and Lubaszka, including <a href="https://investornews.io/marc-lubaszka-illegal-gold-mines-and-back/">the first part of Vargas&#8217;s exposé,</a> which gave a voice to <a href="https://investornews.io/wp-content/uploads/2021/11/steve-gern-fraud-scam-marc-lubaszka-aurum-advisors.png" target="_blank" rel="noopener">the victims</a> of one of <a href="https://investornews.io/marc-lubaszka-illegal-gold-mines-and-back/">Lubaszka&#8217;s prior gold schemes</a> for which he was never prosecuted by law enforcement nearly a decade ago.</h6>
<h6>The reporter took to social media to announce that she was not a party to the settlement agreement and would not be taking down any content. About two weeks later, Oshri filed against Vargas.</h6>

<h6>Court documents filed September 3, 2021 by Vargas’s counsel, Michael Creamer, state that:</h6>
<h6>“It’s out of an acute sense of self-defense that Ms. Oshri has filed for a restraining order. In a brazen attempt to derail the publication of that future article, Ms. Oshri’s motives are exposed. Ms. Oshri has filed this action because she does not want the truth of her participation in PPE scams exposed.”</h6>
<h6>Creamer further writes: &#8220;While it&#8217;s true that Ms. Vargas never revealed to Ms. Oshri all of the information that she has compiled in order to write her article about Ms. Oshri, Mr. Lubaszka and their PPE scam, Ms. Vargas has never had a legal obligation to do so. Yet, Ms. Oshri takes great liberty and license to describe the limits of what Ms. Vargas has compiled and then assert –without any supporting authority– that Ms. Vargas&#8217;s efforts of investigation both support a civil harassment restraining order and bar Ms. Vargas from seeking the protection of the anti-SLAPP statute.&#8221;</h6>

										<content:encoded><![CDATA[<p><strong>Washington D.C.,</strong> Dec. 18, 2020 — The Securities and Exchange Commission today announced charges against California-based biotechnology company Decision Diagnostics Corp. and its CEO, Keith Berman, with making false and misleading claims in numerous press releases that the company had developed a working, break-through technology that could accurately detect Covid-19 through a quick blood test. The SEC <a href="https://www.sec.gov/litigation/suspensions/2020/34-88735-o.pdf">temporarily suspended trading</a> in Decision Diagnostics&#8217; securities on April 23, 2020.</p>

<p>The SEC&#8217;s complaint alleges that Decision Diagnostics and Berman seized upon the global pandemic through a series of press releases that falsely claimed Decision Diagnostics had developed a finger prick blood test that could detect Covid-19 in less than a minute. According to the complaint, from March 2020 to at least June 2020, Decision Diagnostics and Berman made false and misleading statements about the existence of Decision Diagnostics&#8217; Covid-19 device and progress towards FDA emergency use authorization. As alleged, at the time of these claims, Decision Diagnostics lacked a proven method for detecting the virus and had no physical testing device. Further, its advisors had warned that the testing kit they were trying to manufacture would not work as Decision Diagnostics had described. The complaint also alleges that the statements created the misleading impression that the test was soon to be introduced to the market and led to surges in the price and trading volume of Decision Diagnostics&#8217; stock.</p>
<p>&#8220;During this unprecedented time, when the need for truthful disclosures concerning Covid-19 tests is of vital importance, Decision Diagnostics and its CEO allegedly misled investors by claiming to have made a working test device when all they had was an idea that had not materialized into a product,&#8221; said Stephanie Avakian, Director of the Division of Enforcement. &#8220;With the onset of the global pandemic, we quickly pivoted to identify potential areas of fraud. This case is another example of how the Commission will hold accountable those who exploit the pandemic to harm investors.&#8221;</p>
<p>&#8220;In our complaint, we allege that Decision Diagnostics and Berman repeatedly made baseless representations to the investing public about market-moving events like progress in obtaining FDA approval and having breakthrough technology,&#8221; said Anita B. Bandy, Associate Director of the Division of Enforcement. &#8220;Today&#8217;s filing is a credit to the dedicated SEC staff, who continued to investigate after the trading suspension and quickly uncovered the alleged fraud.&#8221;</p>
<p>The complaint, filed in the U.S. District Court for the Southern District of New York, charges Decision Diagnostics and Berman with violating antifraud provisions of the securities laws. The SEC is seeking a court order permanently enjoining both Decision Diagnostics and Berman from directly or indirectly violating those provisions and ordering them to pay civil penalties.</p>

<p>The Department of Justice&#8217;s Market Integrity and Major Frauds Unit announced today that parallel criminal charges against Berman were also filed in the U.S. District Court for the District of Columbia.</p>
<p>The SEC&#8217;s investigation, which is continuing, has been conducted by Ernesto Amparo, Carlisle Perkins and Lesley Atkins and supervised by Jeff Leasure and Ms. Bandy with invaluable assistance by Margaret A. Cain of the Office of Market Intelligence and Hane L. Kim of the Microcap Fraud Task Force, both members of the SEC&#8217;s Coronavirus Steering Committee.
